J1 Visas are
issued each year by the thousands of which many are to international medical
graduates. This allows them to enter the United States and attend residency and
fellowship programs for advanced medical training under the Immigration and
Nationality Act. Once they have completed that training, all of those
physicians are required to return to their home countries to fulfill the
two-year home residency requirement that is a requirement of their
J1 Visa waiver physician status. However, a waiver of that
two-year home residency requirement can be obtained for physicians who have a
qualified sponsoring employer in a qualifying HPSA and
an interested government agency. Once a J1 waiver is obtained, the physician is
eligible to apply for a visa status change that will allow them to remain and
practice in the United States.
The Conrad State 30
program was designed to provide each of the fifty U.S. states with 30 waivers
for J-1 physicians each fiscal year. Each State has been given some flexibility
to implement its own guidelines, but there are some basic requirements that are
common to all State 30 programs. Exchange visitors coming under the J-1 Visa
program for graduate medical education and/or training must meet certain
special requirements. They include having passed the Foreign Medical Graduate
Examination in Medical Sciences, demonstrating competency in English and are
subject to time limits on the duration of their program. Physicians coming to
the United States on exchange visitor programs for the purpose of observation,
consultation, teaching, or research in which there is little or no patient care
are not subject to the aforementioned requirements.
The
process of obtaining a J1 physician visa
is extraordinarily complex. The obstacles to success are so daunting, and the
process so time consuming, that most eligible employers will not even attempt
to sponsor a J1 visa application on their own. Even with the assistance of an
